A BRAZILIAN motorist caught behind the wheel driving with a counterfeit driving licence has been given a six-month suspended jail sentence and ordered to do community service. Jose Zequim, of Faringdon Road, had used the dodgy Italian permit to get insurance for his car as he did not have the proper documentation. But the 50-year-old staunch Catholic escaped an immediate jail term after a judge heard he was deeply ashamed of what he had done.
Rachael Marshall, prosecuting, told Swindon Crown Court that the South American was pulled over by the police in Swindon on March 15. He produced the Italian driving licence which officers thought was a forgery and he was arrested and taken to the police station. When he was questioned he said he had obtained it in 2004 when he lived in Italy and had not taken a driving test there.
He said he had simply completed a form and a man produced the documentation for him which he used before returning to his home country. He came to the UK in 2006.
The licence was examined by the authorities and found to be a fake and it was discovered he had used it to obtain insurance. Zequim pleaded guilty to possessing false identification papers with intent, making a false statement to obtain insurance, no insurance and driving without a proper licence. Marcus Davey, defending, said as he understood the situation his client was in this country perfectly legally. “It is a terrible fall from grace for him,” he said.
“He is 51 years old next week; he has been married for many years and never been in trouble here or in Brazil. “He is a lifelong committed Catholic and a regular member of a local church. Suddenly he finds himself before you facing a criminal record, maybe prison, and the threat of deportation. “There is no excuse for what he did but he feared he would lose his job without a car and driving to and from his employment.” He said that he had a business in Brazil which had led to him being in debt and he feared it may go under if he could not fund it.
“I ask you to accept he is genuinely remorseful,” Mr Davey said. Passing sentence said: “You have pleaded guilty to serious offences and in normal circumstances the court would impose immediate imprisonment.
“I have to take into account the nature of the false documentation concerned and what you used it for. The important feature in your case is that it was not used to obtain residential status in this country. It was used to allow you to drive a vehicle.” He imposed a six-month jail term, suspended for a year, and ordered him to do 150 hours of community service and imposed six points on his licence, should he seek one.
